Unfortunately, in many situations the negligence or intentional act of another ends up in the death of a loved one. In those situations, understandably, the last thing one normally thinks about is contacting a lawyer. Just a few things to consider – first, usually only the executor or administrator of the decedent’s estate can file a lawsuit. Second, remember there is always a statute of limitations in which the estate has to file a lawsuit in court. If the lawsuit is not timely filed, the case will likely be dismissed. Third, although unpleasant to think about, consider having an autopsy performed, especially in neglect cases, an autopsy may be the only way of establishing the true cause of death.
